Invictus Catamaran Charter & Surf Trip Booking Terms

Thank you for choosing Invictus Catamaran. Please read these Terms & Conditions carefully before booking. By making any payment toward your trip, you acknowledge and agree to the terms outlined below.

Terms & Conditions

Reservations & Deposits

  1. To secure your reservation, a non-refundable deposit of 50% of the total charter price is required.

  2. The remaining balance must be paid in full no later than 60 days before the charter departure date.

  3. Once your requested dates are available, Invictus Catamaran will send a booking offer via email or WhatsApp. To confirm your reservation, guests must:

  4. Confirm acceptance of these Terms & Conditions in writing (email or WhatsApp)

  5. Provide a copy or photo of a valid passport.

  6. Submit the required deposit payment.

  7. Failure to pay the remaining balance by the due date will result in cancellation of the reservation and forfeiture of all deposits paid.

Travel Interruptions

Invictus Catamaran is not responsible for losses, delays, itinerary changes, or trip interruptions resulting from:

  • Airline delays or cancellations

  • Weather conditions

  • Ocean or surf conditions

  • Natural disasters

  • Government actions or restrictions

  • Political unrest

  • Pandemics or public health emergencies

  • Port closures

  • Acts of God

  • Personal emergencies or medical issues

Payment Methods

 

Bank Transfer

Guests are responsible for all wire transfer fees, intermediary bank fees, exchange fees, and commissions associated with international bank transfers. Invictus Catamaran must receive the full invoiced amount.

PayPal

PayPal payments are accepted. Any/all fees and additional international transaction fees imposed by PayPal or financial institutions are the responsibility of the guest.

Zelle

Guests may request a Zelle payment request by providing the email address or phone number associated with their Zelle account.

Acceptance of Terms

Any deposit, partial payment, final payment, or transfer of funds made toward a reservation constitutes full acceptance of these Terms & Conditions.

Guest Expenses

Guests are encouraged to bring $100-$500 in small denominations for personal purchases, gratuities, and incidental expenses while in Costa Rica.

Additional onboard purchases, including Invictus Catamaran merchandise and crew gratuities, must be paid directly onboard in cash. Accepted currencies include U.S. Dollars (USD) and Costa Rican Colones (CRC).

Deposits & Transferability

Deposits are non-refundable but may be transferred to another individual or party for the same charter dates, subject to approval by Invictus Catamaran.

If one or more members of a booked group are unable to attend, the charter will remain subject to the original agreed-upon price. No reductions, credits, or refunds will be issued for absent participants.

 

Cancellation Policy

More Than 60 Days Before Departure

Cancellations made 60 days or more before departure are eligible for a future travel credit equal to the 50% deposit paid. This credit must be used within one (1) year of the original departure date.

A cancellation fee equal to 50% of the total charter price will apply.

 

59 Days or Less Before Departure

All payments become non-refundable within 59 days of departure.

No refunds will be issued for unused portions of a trip, no-shows, late arrivals, or early departures.​

No refunds will be issued for circumstances beyond the control of Invictus Catamaran.

Trip Modifications & Vessel Substitution

Invictus Catamaran reserves the right to modify itineraries, destinations, schedules, activities, and surf locations when deemed necessary for safety, weather, mechanical considerations, or operational reasons.

If Invictus Catamaran cancels a trip, a comparable charter, accommodation, or alternative vessel may be offered.

If no reasonable alternative is available, guests will receive a full refund of all payments made directly to Invictus Catamaran. Airfare, hotel accommodations, transportation costs, travel insurance, and other third-party expenses are not refundable by Invictus Catamaran.

Mechanical Failure

If a charter cannot continue due to mechanical or technical issues and no suitable replacement vessel can be provided, guests will receive a prorated refund based on the unused portion of the trip.

 

Medical Emergencies & Safety

The Captain retains full authority regarding the safety and operation of the vessel.

In the event of a medical emergency, accident, injury, unsafe behavior, or any situation affecting the safety of guests, crew, or vessel operations, the Captain may alter or terminate the trip.

No refunds will be provided for trips terminated due to guest misconduct, safety concerns, medical emergencies, or circumstances requiring early termination for the welfare of guests, crew, or vessel.

 

Liability Limitation

Guests acknowledge that participation in boating, surfing, snorkeling, diving, fishing, hiking, and other adventure activities involves inherent risks.

By participating, guests voluntarily assume these risks and agree that Invictus Catamaran, its owners, employees, crew, contractors, and affiliates shall not be liable for personal injury, illness, death, loss of personal property, delays, or damages arising from participation in the trip except where prohibited by applicable law.

 

Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Costa Rica.
